We remove the occupant and the nesting material, clear and sweep the flue it was blocking, sanitize the affected area, then close the entry with a properly fastened cap and screen — the exclusion is the part that actually ends the problem. One legal limit we hold to without exception: chimney swifts are federally protected migratory birds, and an active nest between roughly March and August cannot be removed. The NFPA recommends an annual chimney inspection (Level 1), with sweeping done when buildup reaches 1/8" of creosote. For active wood-burning fireplaces, that's typically once per heating season.
